All services provided by us may only be used for lawful purposes. Transmission, storage or presentation of any information, data or material in violation of laws is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, or material protected by trade secret and other statute. The client agrees to indemnify and hold harmless our hosting from any claims resulting from the use of service which damages the client or any other party.

Prohibited are sites that promote any illegal activity or present content that may be damaging to our servers, or any other server on the internet. Links to such materials are also prohibited.

We offer web hosting services and support. Additional support in relation to HTML/PHP coding, script, website installation, setup or modifications are provided as an additional paid service . Full details of the issue you are facing and how it may have occurred must be provided. We are not a web development company.

By creating an account with us you have read, understood and agreed to our terms within.

Account Activation

By activating your account with us, you agree to the terms of service within. Upon requesting activation of an account, you are required to accept these terms of service, and a copy of your acceptance is forwarded along with your activation request to be maintained with your account information.

NOTICE: If you sign up for an account and fail to comply with these terms, your account can be suspended without warning. No refunds will be given.

From time-to-time we may select accounts at random to perform security and confirmation checks. This will involve you providing two proofs of identity before allowing you to continue using our services. We would require proof of your full name and address within 7 days of your account being setup. This can include, but is not limited to; passport, driving licence, birth certificate, department of defence or military ID, national ID card and utility bill with full address. These details must match with your payment method and our team will carry out checks within 48 hours of receiving your documents. Failure to provide such proof within 7 days will result in account suspension and services terminated. All documentation received is securely destroyed once our checks have been completed. False documentation will be reported to the authorities.

– Sites distributing copyrighted content without proper licenses

– Hacker programs, credit card dumps, hacker focused sites

– Forums distributing warez or any other illegal content
– Fraudulent sites (fake banking services, fake login pages, any other site mining information in illegal ways)
– Malware, viruses, trojan horses, mass ping, ddos, udp or tcp flood scripts, or other kind of desctructive scripts

We do not allow domains/subdomains with ‚paypal‘ or any other services names, for example ’sony‘, ‚google‘ and etc.

NOTICE FOR REPEAT OFFENDERS: IF YOUR ACCOUNT IS FOUND TO CONTAIN ILLEGAL ACTIVITY, ILLEGAL MP3 FILES, PIRATED SOFTWARE, HACKER PROGRAMS, WAREZ PROGRAMS, OR ANY OTHER ILLEGAL FILES, YOUR ACCOUNT WILL BE TERMINATED IMMEDIATELY, WITHOUT NOTICE, AND WE RESERVES THE RIGHT TO UNDERTAKE COURT ACTION AND WE WILL NOTIFY THE PROPER AUTHORITIES OF YOUR ACTIONS.

It is ultimately your responsibility to ensure that your website and account does not host, or have stored in anyway, any of the above banned script, website or file types. we may provide virus and malware scanning capabilities from time to time at our sole discretion. Traffic Usage

All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and suspend accounts if limits are exceeded.

Server Abuse

Any attempt to undermine or cause harm to a server or client is strictly prohibited. As our client you are responsible for all your accounts. Should you violate the Terms of Services outlined within, your account will be cancelled/suspended without refund.

Refusal Of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

All sub-networks, and our distributive hosting sites must adhere to these terms.

Billing

By the Account Activation Date of each month, we shall either:

(1) debit the client’s credit/debit card or PayPal account (when such information has been provided by the client); or

(2) deliver, by e-mail, an invoice in accordance with the applicable service fees for services rendered. When an invoice is delivered to the client, payment shall be remitted to us by no later than the specified payment due date. We shall be entitled to immediately terminate/suspend this agreement for a client’s failure to make timely payments. It is the client’s responsibility to ensure that their account is not overdue on payment. We will send an e-mail notification, at which point we will need to be provided with payment or an alternative method of payment such as; credit/debit card or PayPal.

If the outstanding invoice remains unpaid for a total of 7 days, your account will automatically be suspended beyond our control. Your service will resume automatically upon payment of the outstanding invoice.

If your account remains overdue and unpaid for a total of 45 days after your payment due date, then your account will be terminated immediately. This will result in a total loss of your website files, MySQL databases and email accounts. These will all be unretrievable and we cannot be made liable for such instances. You are asked to agree to these terms at point of sale in order for an account to be created. It is your responsibility to ensure your account does not go overdue.

We reserves the right to change fees, surcharges, renewal fees or to institute new fees at any time, for any reason, at its sole discretion. By agreeing to our terms within, you have read, understood and accepted this can be the case.

Payment Disputes & Chargebacks

If there is a problem, or you would like a refund, please talk to us and let us know. Payments can sometimes be disputed through your bank, credit card company, or PayPal. When this happens, the transaction is reported as unauthorized or fraudulent, and we are fined £15.00 or a percentage of the amount disputed by our payment processor for each occurrence. Whilst the charge is in dispute, your account will be suspended.

You will need to cancel the dispute on the payment through your bank, credit card or PayPal so that we have the option to refund the charge. While the dispute is active we do not have the option to issue a refund. If you prefer not to cancel the dispute or it is too late, you will be refunded once the payment provider has completed the dispute resolution, which can take up to 75 days.

If you would like to continue using your site:

1. If the dispute was done recently, you might be able to cancel the dispute with your bank or PayPal. Once you’ve canceled the dispute, please let us know, and we’ll assist you in restoring your site.

2. If you prefer not to cancel the dispute or it is too late, you will be refunded once the payment provider has completed the dispute resolution, which can take up to 75 days. In this case, a £15.00 fee must be paid if you’d like to restore your web hosting account.

Service Fees

Certain services carry a setup fee charged to the client, which must be paid by the client in order to have use of said services. If the client terminates this agreement, the client shall be responsible for any and all outstanding fees owed to us and agrees to pay any and all fees incurred by the client. Because the services are provided on a monthly basis, the client will be responsible for service fees incurred each month, regardless of when the client provides notice of termination. Thus, for example, if the client provides notice of termination on the 15th day of a particular month, the client will be responsible for service fees for the entire month, and such fees will not be pro-rated or refunded.

Money Back Guarantee & Refund Policy

If a request is submitted for an immediate cancellation within the first 30 days, a full refund will be issued. Applies to all web hosting packages excluding domain names.

Refunds on a prepaid account after 30 days: If the client has pre-paid us for web hosting services, refunds will be issued for any unused full month of such services, upon the client’s request. Therefore, if the client’s account is cancelled at any point during the one, two or three year term, the client will be entitled to a refund for the months remaining, after notice given by the 28th day of the current month. Notice given after the 28th day will count as the following month.

Refunds are not applicable to the services bought through Special Discounts Offers.

We DO NOT refund partial monthly fees to accounts. Domain registrations, domain addons, setup fees and migration fees are not refundable.

For FREE domain registrations the retail price of the domain will be deducted from the refund amount upon cancellation if applicable. Alternatively, if the refund amount is less than the retail price of the domain, you will be invoiced for the difference. Once the invoice has been settled, only then will you retain ownership of the domain.

Promotions

From time to time we will run various promotions using coupon codes. Unless enabled or specifically mentioned, these are to be used for new clients only on their first order. Anyone found to be using these inappropriately, by circumvention or is not a new client, will risk having their account suspended. We also reserve the right to immediately terminate and close accounts where we see fit to do so. You may also be banned from our plaform indefinately. We may, at our discretion, ask you to make payment for the difference between the correct package price and the discounted amount.

The above mentioned terms are in place to protect the services we offers to our clients. By breaking these terms you are creating a detremental impact. This will not be tolerated.

Cancellation Requests

Any immediate cancellation notification requests from within the client area are treated as such and will be processed within 24 hours. We strongly suggest that all vital website information is backed up and removed before requesting a cancellation. Once cancelled the account will be terminated and all information within that account will be securely destroyed including any automated backups.

Any end of billing cancellation notification requests from within the client area are treated as such and will be processed at the end of the current billing period for the client’s applicable web hosting service. We strongly suggest that all vital website information is backed up and removed before the end of the billing period. Once cancelled the account will be terminated and all information within that account will be securely destroyed including any automated backups.

It is your responsibility to cancel any active subscription that may be in place with your payment method, such as PayPal or direct debit, to avoid any further automated payments where applicable.

Cancellation Of Service

We reserves the right to cancel a service at any time. All fees paid in advance of cancellation will be pro-rated and paid by us where eligible and applicable.. Any violation of policies which results in extra costs will be billed to YOU.

Account Deactivations

Unsolicited commercial advertisements (‚SPAM‘) are not allowed in e-mail, and will likely result in account cancelation. We take a zero-tolerance approach to SPAM originating from its servers or for spam advertising of domains hosted within our network. If found, YOUR account may be deleted.

Any account deactivated due to non-payment will require the full outstanding balance to be paid plus any late payment fees before reactivation can take place. This is an automated process of which we have no control over.

Any attempt to setup a new active account will result in a total ban from our hosting services. You will be unable to obtain any services from us or our partners and will forfeit the right to retrieve your data from your web hosting account. All requests will be ignored as you will no longer be our client .

Account deactivation can also occur as a result of ‚time wasting activities‘. For example; submitting multiple support requests, either via email, support ticket or live chat regarding the same issue despite it being resolved or responded to previously multiple times. Whilst every effort is made to ensure that the contact details we have, or the email addresses provided to us are correct, and that we have gained as much information as possible from you to resolve the issue quickly and effectively, it is ultimately the user who inputs and advises us of this information that is responsible for the accuracy of this information.

Refusal Of Service

We reserve the right to refuse, cancel or suspend service, at our sole discretion.

Limitation Of Liability

We shall not be responsible for any claimed damages, including incidental and consequential damages, including loss of earnings or sales revenues, which may arise from our servers going offline or being unavailable for any reason whatsoever. Furthermore, we shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any website from one of our servers. All damages shall be limited to the immediate termination of service.

Violations

Violations of these Acceptable Use Policies should be referred to us via our Resolution Centre. All complaints will be investigated promptly. Failure to follow any term or condition will be grounds for immediate account deactivation.

DMCA

We provide legal copyright owners with the ability to self-publish on the internet by uploading, storing and displaying various media utilising our services. We do not monitor, screen or otherwise review the media which is uploaded to our servers by users of the service. We take copyright violation very seriously and will vigorously protect the rights of legal copyright owners. If you are the copyright owner of content which appears on a website hosted by us and you did not authorise the use of the content you must tell us in order for us to identify the alleged infringment and take action.

Violations should be referred to us via our Resolution Centre. You must provide the following:

– Full Name
– Address
– Phone Number
– Email
– Name of Infringing Work
– Original Content URLs
– Infringing Content URLs

All notices are investigated promptly. Even if you believe you didn’t steal it, you must remove it. Until you can confirm ownership and get the situation settled, removing the content in question will protect you from any further action from either the person claiming to own the content, or from your Internet Service Provider (ISP). Failure to do so may result in immediate account deactivation.

Domain Registrant Agreement

If you allow your domain to expire the domain will not be accessible therefore, any services associated with it will stop working. You may be able to renew it for up to 28 days after the renewal date but this is not guaranteed. A redemption fee of $250 plus the domain renewal price is charged if your domain expires and you wish to keep it.

All domain name purchases are non-refundable.

Domain Name Registration

YOU agree to pay us prior to the effectiveness of the desired domain name registration, the then-current amount set forth in our price schedule for the initial registration of the domain name and, should YOU choose to renew the registration, subsequent renewals of the registration. All fees are non-refundable, in whole or in part, even if YOUR domain name registration is suspended, canceled or transferred prior to the end of YOUR then current registration term. We reserves the right to change fees, surcharges, renewal fees or to institute new fees at any time, for any reason, at its sole discretion. YOUR requested domain name will not be registered unless and until we receive actual payment of the registration fee, and have confirmed YOUR registration in an email from us to the email address indicated in YOUR registration application. It is your responsibility to ensure the domain name purchased is correct and that it is renewed or not renewed in plenty of time before the due date. We will attempt to auto-renew your domain up to 7 days before the due date to ensure; that payment is cleared in time before the due date, and to secure the domain for the registrant. You can disable auto-renew within your Client Area under the Domains section. Any attempt to claim a refund on a domain which has been purchased or renewed may result in account limitation and/or suspension of services due to non payment, and a chargeback fee may apply. See our Payment Disputes & Chargebacks section for more details.

In the event of a chargeback by a credit card company (or similar action by another payment provider allowed by us) in connection with the payments of the registration fee for YOUR domain name registration, YOU agrees and acknowledges that the domain name registration shall be transferred to us as the paying entity for that registration to the registry and that we reserve all rights regarding such domain name including, without limitation, the right to make the domain name available to other parties for purchase. We will reinstate YOUR domain name registration solely at our discretion, and subject to our receipt of the initial registration or renewal fee and our then-current reinstatement fee.

Transfer domain registrar to us

YOU agree to pay us prior to the effectiveness of the desired domain name transfer request, the then-current amount set forth in our price schedule for the initial transfer request of the domain name. YOU agree and acknowledge that the domain name transfer will fail, and all fees are non-refundable, for the following reasons, but not limited to:

– No response from the Registered Name Holder or Administrative Contact
– Domain name in Registrar Lock Status
– Domain name registration period time expires or other constraints, other than during the first 60 days of initial registration or during the first 60 days after a registrar transfer

We reserves the right to change fees, surcharges, renewal fees or to institute new fees at any time, for any reason, at its sole discretion. YOUR requested domain name will not be registered unless and until we receive actual payment of the registration fee, and have confirmed YOUR registration in an email from us to the email address indicated in YOUR registration application. In the event of a chargeback by a credit card company (or similar action by another payment provider allowed) in connection with the payments of the registration fee for YOUR domain name registration, YOU agrees and acknowledges that the domain name registration shall be transferred to us as the paying entity for that registration to the registry and that we reserve all rights regarding such domain name including, without limitation, the right to make the domain name available to other parties for purchase. We will reinstate YOUR domain name registration solely at our discretion, and subject to our receipt of the initial registration or renewal fee and our then-current reinstatement fee.

Transfer domain away from us

We reserves all rights, without limitation, to reject the domain name transfer request for the following reasons, but not limited to:

– No response from the Registered Name Holder or Administrative Contact
– Domain name in Registrar Lock Status and there is no request from Registered Name Holder or Administrative Contact for the status change
– Domain name registration period time will be expiring in less than 60 days or other constraints, other than during the first 60 days of initial registration or during the first 60 days after a registrar transfer

YOU agree and acknowledge that the failure or success of a domain name transfer will be his/her sole responsibility, and we will not be held liable for the failure of a domain name transfer for any reason.

Domain registrations are non-refundable. Please do not purchase the domain name until you are certain that it is exactly what you would like to buy.

FREE Website Migration

We offer a FREE website migration service to move your website from your current web host to us. This can be done within 24-48 hours, but we will always aim to have it transferred within 24 hours or less upon receipt of a support ticket from you requesting this transfer. Your website must be under 2GB including any databases & email accounts that come with it. If it is over 2GB in total, we would suggest reducing its size to below 2GB to be eligible for the FREE migration service. Anything over 2GB is charged at $1 for each additional 1GB of data. This is non-refundable.

We cannot guarantee the following; to transfer every file and for your website to be working and operational, that every email account and its contents is transferred in full & to transfer your site within 24 hours. However, we will do our best to assist you in getting your website back to the same standard it was with your previous host.

UNLIMITED Usage Policy

We offer some of our hosting packages with “Unlimited” amount of resources for specific options (disk drive space, bandwidth, domains per account, and others). This means that we will not set a specific cap for these resources and the client will be able to use these resources as needed, however fair usage applies to all accounts. If a client uses the resources of the shared server to the extent where he is negatively affecting other users hosted on the same server, the client may be suspended with or without warning and advised to upgrade their account to a package more suitable for their needs or fixes the issues so the resource usage on their account stops and no longer negatively affects other users on the same shared server. This includes any one available resource to that account such as disk space, bandwidth, email accounts and mysql databases where it negatively affects other users hosted on the same server.

By the term “Unlimited Space” we mean that no cap will be set on the amount of files the user may host on his account, however the space on the hosting account cannot be used for: Backup storage, Online storage, File sharing services, Movie storage, Photo storage, Audio storage, Software storage, Copyrighted content storage, Illegal, Abusive or Offending file storage, Document Archives or any other type of Archive, File Backups (with the exception of a single cPanel backup generated from your cPanel), log files, etc. or streaming. We reserve the right to remove such files from the user account with or without notice to the client.

We also reserves the right to remove any single files larger than 1GB from the user account regardless of the content of the file with or without notice to the client.

We also reserves the right to clean up a user account by removing files which fall under the criteria of files that may not be hosted on our accounts, if there are more than 500,000 files on a single account, with or without notice to the client. We also reserves the right to disable the account which holds more than 500,000 files until the relevant shared hosting account is upgraded by the client to a service where such limitation is not applied.

We have an automated weekly backup system in place which backs up all user accounts no larger than 2GB in total size every 7 days. We cannot guarantee that these backups will be available at anytime. Accounts over 2GB in total size will not be backed up via our automated backup system. However, users are able to utilise the cPanel Backup facility in their cPanel accounts for manual backups.

Server Uptime Guarantee

We guarantees 99.9% service (http, ftp, pop, imap, smtp) uptime on all hosting plans. This is calculated over the course of a 12 month period. Should we fail to deliver this, your account will be credited once for the amount of your normal monthly package price.

The availability of a website is measured by a percentage usually over a 12 month period in which the website is publicly accessible and reachable via the internet. This is different from measuring the uptime of a system. Uptime refers to the system itself being online. Uptime does not take into account being able to reach it as in the event of a network outage.

How downtime is determined changes from provider to provider. We will guarantee at least 99.9% uptime which will allow for 43m of downtime per month, or 8h 45m of downtime per year. This allows us to perform maintenance on systems and servers when required.

We reserve the right to amend any or all of these terms without notification. We also retain the right to increase any pricing and make changes to our account plans without notification.

IP Address Ownership

We shall maintain and control ownership of all IP numbers and addresses that may be assigned to YOU . We reserve, in our sole discretion, the right to change or remove any and all such IP numbers and addresses.

Privacy

We follow the strict guidelines of our Privacy Policy. Please make sure you understand this fully.

Information Automatically Logged

We use your IP address to help diagnose problems with our server and to administer our website. We may also use this information for site security, fraud prevention and maintaining these terms of service.

Static & Dynamic Content Caching

YOU expressly

(i) grant to us a license to cache the entirety of YOUR website, including content supplied by third parties, hosted by our server under this Agreement and
(ii) agree that such caching is not an infringement of any of YOUR intellectual property rights or any third party’s intellectual property rights.

Order Forms

Our site uses an order form for clients to request services. (128 bit encryption). We collect sensitive information which is used only for our purpose, no third party receives any type of information from us.

Contact information from the order form is used to get in touch with the client when necessary.

Billing information that is collected is used to bill the client for services.

Unique identifiers are collected from website visitors to verify the user’s identity.

Demographic and profile data is also collected on our website.

We use this data to tailor our visitor’s experience on our website showing them content that we think they might be interested in, and displaying the content according to their preferences.

Electronic Commerce

YOU will be solely responsible for the development, operation and maintenance of YOUR online store and products along with all content and materials appearing online or on YOUR products, including without limitation:

(a.) the accuracy and appropriateness of content and materials appearing within the store or related to YOUR products,
(b.) ensuring that the content and materials appearing within the store or related to YOUR products do not violate or infringe upon the rights of any third party, and
(c.) ensuring that the content and materials appearing within the store or related to YOUR products are not libelous or otherwise illegal. YOU will be solely responsible for the final calculation and application of shipping and sales tax. YOU will also be solely responsible for accepting, processing, and filling any customer orders, and for handling any customer inquiries or complaints arising there from.

YOU are also responsible for the security of any customer credit card numbers and related customer information YOU may access as a result of conducting electronic commerce transactions through YOUR website. YOU will keep all such information confidential and will use the same degree of care and security as YOU use with your confidential information.

Security

Our site has security measures in place to protect the loss, misuse, and alteration of the information under our control. We use strong SSL encryption to ensure your privacy.

Network Security

Customers may not use our network with an attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for YOU, logging into a server or account YOU are not expressly authorized to access, password cracking, probing the security of other networks in search of weakness, or violation of any other organization’s security policy. YOU may not attempt to interfere or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. we will cooperate fully with investigations for violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability.

Third Parties

Information collected on this site is strictly for our use, NO OTHER OUTSIDE PERSONS MAY VIEW YOUR PERSONAL INFORMATION SUCH BILLING INFORMATION, ETC.

Lawful Purpose

We reserves the right to refuse service to anyone. YOU may only use our server for lawful purposes and our services may not be used for adult related materials or illegal purposes or in support of illegal activities. We reserve the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrongdoing. If anything is not legal, it is not permitted to reside on our servers. Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes but not limiting material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: ‚Pirated Warez‘, OGG, AVI, MPEG, ISO, ‚Hacker programs or archives‘, ‚Copyrighted Digital Movie Copies (DIVX)‘ and ‚Unlicensed MP3‘. The designation of any materials as such described above is left entirely to the discretion of our management.

If illegal content or usage is found, the account will be suspended and/or terminated. YOU agree that we may disclose any and all YOUR information including assigned IP numbers, account history, account use, etc. to any law enforcement agent who makes a written request without further consent or notification.

Intellectual Property Rights

Material accessible to you through our services may be subject to protection under the copyright laws, or laws protecting trademarks, trade secrets and proprietary information. Except when expressly permitted by the owner of such rights, YOU must not use our servers and network in a manner that would infringe, violate, dilute or misappropriate any such rights, with respect to any material that you access or receive through our network. If YOU use a domain name in connection with us or similar service, YOU must not use that domain name in violation of any trademark, service mark, or similar rights of any third party.

Promotional Rates & Special Offers

We may offer subsequent promotional rates or special offers, the terms of which may or may not be more favorable than the terms and conditions for YOUR Services. Any such promotions or modifications shall not effect YOUR obligations under this Agreement. Promotional fees may be subject to additional terms and conditions which, to the extent they conflict with the terms of this Agreement, shall govern. Different promotional fees and special offers may not be combined together.

Disclaimer

We cannot be held liable for system down time, crashes or data loss. We cannot be held liable for any predicated estimate of profits which a client would have gained if their website was functioning. Certain services provided by us are resold. Thus, certain equipment, routing, software and programming used by us are not directly owned or written by us. Moreover, we hold no responsibility for the use of our client’s accounts. Failure to comply with any terms or conditions will result in the automatic deactivation of the account in question. We reserve the right to remove any account, without advance notice for any reason without restitution, as we see fit.

We always advise that it is the client’s responsibility to maintain their own account backups. our backup services are provided as an additional free service and cannot be relied upon.
